1. Introduction

This site, ENVIRODISC.COM.AU and this Agreement sets forth the terms and conditions which apply to the use by you .

ENVIRODISC.COM.AU and its owner VIA International Sydney Pty. Ltd. shall have the right at any time to change or discontinue any aspect or feature of the ENVIRODISC.COM.AU Sites including, but not limited to, the Community Areas, content, hours of availability, and equipment needed for access or use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including but not limited to, posting on the Community Areas a revised version of this Agreement or notification by electronic mail. Any use by you of the Community Areas after such notice shall conclusively be deemed to be acceptance by you of such changes, modifications, additions or deletions. You agree to review the terms and conditions of this Agreement periodically to be aware of such revisions.

2. Use of the ENVIRODISC.COM.AU Sites

A. All materials on this site (the "Content") is the property of VIA International Sydney Pty. Ltd. or its licensors and is protected by copyright, trademark or other intellectual property laws. You may retrieve and display content from the site on a computer screen, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disc (but not on a server or other storage device connected to a network) for your personal non-commercial use. You may not modify, publish, transmit, display, participate in the transfer or sale, create derivative works, or in any way exploit the content of the ENVIRODISC.COM.AU Sites or any portion of it. Except as otherwise expressly permitted under copyright law, you may not copy, redistribute, publish, display or commercially exploit any material from the ENVIRODISC.COM.AU Sites without the express permission of VIA International Sydney Pty. Ltd. and any other copyright owner. In the event of any permitted copying, redistribution or publication of material from the ENVIRODISC.COM.AU Sites, no changes in or deletion of author attribution, trademark, legend or copyright notice shall be made. You acknowledge that you do not acquire any ownership rights by downloading copyrighted material. You acknowledge that "Ascet.com" and slogans are trademarks and that you may not use them without written permission from VIA International Sydney Pty. Ltd. You shall not upload, post or otherwise make available on the Community Areas any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right. You are responsible for determining that such material is not protected by copyright, trademark or other proprietary right. You shall be solely liable for any damages resulting from any infringement of copyright, trademark or other proprietary right, or any other harm resulting from any uploading, posting or submission.

B. ENVIRODISC.COM.AU may give you the option to subscribe to an e-mail newsletter. Your use of the content received through the e-mail newsletter will be subject to these Terms.

C. You may not (i) select or use a member name or e-mail address of another person with the intention of impersonating that person; (ii) use a member name or e-mail address of anyone else without authorization; (iii) use a member name in violation of the intellectual property rights of any person; or (iv) use a member name that ENVIRODISC.COM.AU considers to be offensive.

D. The ENVIRODISC.COM.AU Sites contains links to other web sites, resources and advertisers. VIA International Sydney Pty. Ltd. is not responsible for the availability of these external sites nor does it endorse or is it responsible for the contents, advertising, products or other materials made available on or through such external sites.

E. The provisions of this section are for the benefit of ENVIRODISC.COM.AU, its affiliates, third party content providers and licensors, and each shall have the right to assert and enforce such provisions directly on its own behalf.

F. VIA International Sydney Pty. Ltd. has carefully designed the ENVIRODISC.COM.AU Sites with the purpose of delivering certain content to users in a particular format and with a particular appearance. No third party shall have the right to utilize the content of the ENVIRODISC.COM.AU Sites in any way that interferes with that purpose. In particular, Via International Sydney Pty. 3. Disclaimer of Warranty; Limitation of Liability

The ENVIRODISC.COM.AU Site is provide on an "as is", "as available" basis without warranties of any kind, either expressed or implied, including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and are incapable of exclusion, restriction or modification under laws applicable to this agreement.

The Disclaimers of Liability contained in this section apply to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unathorised access to, alterations of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action. You specifically acknowledge that VIA International Sydney PTY LTD is not liable for the defamatory, offensive or illegal conduct of other users or third parties and that the risk of injury from the foregoing rest entirely with you.
C. In no event will VIA International Sydney Pty. Ltd. or any person or entity involved in creating, producing or distributing the ENVIRODISC.COM.AU sites be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of or inability to use the ENVIRODISC.COM.AU site or out of the breach of any warranty. You hereby acknowledge that the provisions of this section shall apply to all content on the ENVIRODISC.COM.AU site. ENVIRODISC.COM.AU'S liability to users, if any, shall in no event exceed the total amount paid to ENVIRODISC.COM.AU.

The Site contains links to other World Wide Web sites provided by independent third parties ("Third Party Sites"), either directly or through frames. Third Party Sites may be co-branded with ENVIRODISC.COM.AU and may include ENVIRODISC.COM.AU's trademark. ENVIRODISC.COM.AU is not responsible for the availability or content of Third Party Sites and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such Third Party Sites.

5. Competitions and Free Prizes

From time to time VIA International Sydney Pty Ltd may run competitions, free prize draws and promotions on the Site. These may be subject to additional terms that will be made available at the time of such competitions.

6. Indemnification

You agree to defend, indemnify and hold harmless VIA International Sydney Pty Ltd, its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys' fees, arising out of the use by you of the ENVIRODISC.COM.AU Sites.

7. Trademarks

All trademarks appearing on the ENVIRODISC.COM.AU Sites are the property of their respective owners, including, in some instances, VIA International Sydney Pty Ltd.

8. Changes to these Terms

VIA International Sydney Pty Ltd shall have the right at any time to impose, change or modify its fees and billing methods, or other terms and conditions applicable to your use of any paid services or to impose new terms and conditions. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on the ENVIRODISC.COM.AU Sites a revised version of this Agreement or notification by electronic or conventional mail. If any such change is unacceptable to you, you may terminate the service. Any use of the service by you after such notice shall conclusively be deemed to constitute acceptance by you of such changes, modifications, additions or deletions. You agree to review the terms and conditions periodically to be aware of such revisions. You may also be subject to additional terms and conditions imposed by third party content providers in connection with third party content, software or services.

9. General

This Agreement and any operating rules for the ENVIRODISC.COM.AU Sites and the Community Areas established by VIA International Sydney Pty Ltd constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import. If any of the provisions of these terms are found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not effect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.

10. Deliveries and refund policies for on-line purchases

EnviroDisc is guaranteed up to 30 days from the date of purchase for performance. If you are not satisfied with the performance of the discs you will receive a full refund of the purchase price plus postage. Feedback is always appreciated.

The product will be posted to you (by Australia Post) once your payment has been confirmed.

11. Disclaimer

Please accept that Via International Sydney Pty Ltd can not be held responsible for damages to washing machines and garments caused by improper use of the discs.
